1. Employees and their immediate family members and members of the households of employees of AGT Battery Supply, LLC are not eligible to participate in our contest.

2. All winners must be at least eighteen (18) years of age to participate.

3. AGT Battery Supply, LLC will approve all tattoos before they are released for general population viewing and rating. AGT Battery Supply, LLC has sole discretion to not approve what they deem to be profane or distasteful tattoos. There will be no display of tattoos containing nudity or profanity.

4. The winner will be based on the highest overall rank AND number of votes. AGT Battery Supply, LLC principals will select the winner, at random, from the top 5 ranked.

5. The winner of our contest must provide a Social Security Number for tax reporting purposes, and will be responsible for the payment of any federal, state or local taxes in conjunction with the award and use of a prize.

6. By participating in this contest you release AGT Battery Supply, LLC from liability in connection with the operation of the contest, and the award and use of the prize, and giving AGT Battery Supply, LLC the right to use the contest winner’s name, likeness, voice, biographical information and recorded comments in connection with the advertising and results of the contest.

7. AGT Battery Supply, LLC undertakes no liability or responsibility, and makes no warranties, express or implied, with respect to the performance of the prize awarded, for any failure to perform or negligent performance, or for any other risk, incident or damage, direct or indirect, relating to or arising out of the contest, including (but not limited to) damage or expense arising from or occurring during the use of the prize. AGT Battery Supply, LLC is not responsible for damage to a prize or loss of a prize after the prize has been claimed.

8. Any dispute or controversy arising out of or in connection with the administration of our contests shall be resolved by the management of AGT Battery Supply, LLC, whose decisions are final and binding.

9. AGT Battery Supply, LLC reserves the right to make changes in the contest rules at any time, which changes will become effective upon announcement.

10. Failure to conform to all contest rules or fraud on the part of a contest participant will result in the disqualification of such contest participant.

11. AGT Battery Supply, LLC is not responsible for the failure of any telecommunication system or part thereof, or for lost, late or misdirected contest entries.

12. Void where prohibited. All federal, state and local laws and regulations apply.

13. No purchase required to enter the contest and a purchase will not increase your chances of winning.

14. Contest winner will be contacted by email. AGT Battery Supply, LLC shall use such effort as, in its sole discretion, it deems reasonable to notify the winner of the award of prizes and AGT Battery Supply, LLC shall not be responsible if any such notice is delayed, lost, misdelivered, or misdirected. The contest prize will be mailed to the winner at an address within the Continental Unites States, Hawaii, Alaska, or Military APO or FPO address only.

15. The winner will have 10 days of receipt of such notice to provide their Social Security Number to AGT Battery Supply, LLC and to claim the prize. Otherwise the prize will be forfeited. If a prize award notification is not effective, or a winner fails to claim a prize or return the required information to AGT Battery Supply, LLC, then an alternate winner may, in the discretion of AGT Battery Supply, LLC, be chosen from among the remaining contest participants in the same manner as provided for the selection of winners.

16. Prizes are not transferable, and may not be redeemed for cash, or substituted, except that AGT Battery Supply, LLC reserves the right to substitute a prize of equal or greater value if the advertised prize is unavailable.

17. To the extent that any aspect of this contest is offered, administrated, or functions through or by the Internet, and/or AGT Battery Supply, LLC web site, and/or e-mail, AGT Battery Supply, LLC shall not be responsible or liable if the Internet, or the AGT Battery Supply, LLC web site, or e-mail, for any reason, is not capable of properly functioning, for any reason, nor shall AGT Battery Supply, LLC be responsible or liable for: (1) infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of AGT Battery Supply, LLC which corrupts or affects the administration, security, fairness, integrity, or proper conduct of this contest; (2) any error, omission, interruption, deletion, defect, delay in operation, faulty transmission or communications, line failure, theft, destruction, or unauthorized access to any contest activities conducted or information transmitted via the Internet; (3) any problem or technical malfunction of any telephone network, telephone line, cable network, cable line, computer on-line system, server, equipment, or software; (4) any failure of any e-mail entry due to technical problems or traffic congestion on the Internet or at any web site, phone or fax or cable lines, or any combination thereof; and (5) any injury or damage to a Contest participant’s computer or peripheral equipment or software related to or resulting from participation in this contest. To the extent that the requirements of the contest requires or permits entry on-line by e-mail, any dispute that may arise as to the identity of a participant, the authorized holder of the e-mail account, as identified by the Internet provider of the e-mail account, shall be deemed the legal participant.

18. The contest is conducted in the English language and AGT Battery Supply, LLC shall not be responsible for any printing, typographical, administrative, or technological errors in the offer, presentation or administration of the contest.

19. All entries shall become the property of AGT Battery Supply, LLC and will not be acknowledged or returned. Any unauthorized use of the entries submitted shall be not the responsibility of AGT Battery Supply, LLC

20. AGT Battery Supply, LLC reserves the right, in its sole discretion, to disqualify any participant for suspected or actual cheating or non-adherence to these contest rules. Any contest participant who enters or attempts to enter multiple times under multiple addresses, or other artifice to enter more than permitted will be disqualified.

21. The contest, the contest rules and any prize awarded is subject to (1) applicable laws, including the laws of the stat of New Jersey, and shall be void where prohibited thereunder, and (2) AGT battery Supply, LLC’s official website privacy policy. In the event of any claim or dispute with regard to the contest or the contest rules, the laws of the State of New Jersey shall govern and apply, without regard to conflict of law provisions. Participants agree to submit to the jurisdiction of the courts of the State of New Jersey with respect to any claim or dispute with regard to any aspect of the contest or the contest rules.

22. Each contest participant: (1) acknowledges acceptance of these contest rules and agrees to adhere to and be bound by them, and (2) releases, holds harmless, AGT Battery Supply, LLC, and assigns, from and against all claims, losses and damages incurred by participant or participant’s representatives, directly or indirectly, in whole or in part, arising from or in connection with or related to, the operation of, or participation in, the contest.
